They were on finaly approach to the docking port, normaly he would be happy to be back at star base. It meant up grades for his ship and R&R for a tired crew. He arleady filed his report after the last mission and knew there would be questions to answer. Any time a star ship made a time travel trip star fleet go worried.
He had to smile some a little about that, to begin with if he had changed the time line nobody from star fleet would know. Only the crew would no if things had changed. So he found it funny that they would be checking to see if anything would have changed.
Still he wasn't looking forward to his time here, there was the issue of his LT and the charges being leveled against him. He knew people made mistakes and everybody deserved a 2nd chance. Still he didn't want to loose his ops officer he would be hard to replace. Even though he had only been in command a short time he cared for each memeber of his crew.
As he felt the docking clamps grab the nevada and the ship switch to external power. He knew it would be only a matter of time before they recieved word about the time and place of Seth meeting.
Opening a com channel through out the ship. " All senior officers report to my ready room before beging R&R. Please feel free to put your departs on leave for the next 72hrs. Commander Park please report to me as soon as possible along with Mr. Seth "

Dunowin and his assistant made the final rounds of Engineering before letting everyone go on leave.
"Everything appears to be in order, sir." his ACEO stated.
"So it does." Dunowin replied. "Go ahead and take off. I'm gonna go see what the Colonel needs and than head over myself. Let's get together for a drink later."
As the young Lt(jg) left, Dunowin went to his office to file his final report. Once it was all done, he loaded it onto a PADD and headed for the COs ready room. He exit the turbo lift on the bridge and approached the door. It singled his presence to the Colonel on the other side.

Commander Park walked the ship one looking for Seth and two to make sure the ship was secure and all departments were getting set for R&R, Jon was proud of his crew they had been working hard for the past few weeks and needed a breck. Jon knew he would make time to see his mother and Father.
Jon heard his CO's orders and knew the bridge was his last stop, Having not found Seth jon headed for the bridge. he looked for the Colonal not seening him on the bridge he went to the ready room.
Jon tapped the control for the door chime and waited

Sitting in his office he heard the chime and stayed enter. A few moments later his first officer was entering his office early and expected.
" Commander take a seat I'm glad your hear although I was hoping Seth would be with you. Oh well you can inform him later. Commander since you have decided to represent Seth Star Fleet has decided to relieve of your duties on a temporary bases" he saw the look on his Xo face.
" Commander its only temporary once this investigation is concluded you return to your positon. Its Star fleets feeling as well as my own that considering the nature of this investigation and your role in that you be free from your normal duties to focus on the task at hand. You will have access to what ever you need to help in this keep in mind some of the crew will be pulling double duty."
pausing for a moment " Commander I want you to keep in mind that what ever you ask the crew or have us help you more so myself. I will be regulation bound to notify the opposing side. I'm not saying not to ask for help by no means. I suggest that what you ask doens't damage your case streneght. Star Fleet is taking this matter very strongly and looking for something and I'm not quite sure what it is yet. Something like this is getting alot more attention then it normaly should. If you have any questions let me know okay"
a few moments later LT Dunowin was in his office " If you will excuse Commander Park I have a personal matter to talk about with our chief engineer" a few moments later Park left and it was just him and Dunowin
" Mr. Dunowin what I"m about to ask if off the record and you are by no means required to do it. God knows you could use some R&R but I have a favor to ask, personal in nature. As I'm sure you know Mr. Seth and Mr. Park are involved in a investigation of Mr. Seth past Mr. Park is representing Mr. Seth. What I'm asking you is for some help this investigation is got me bugged the fact that it has this much attention. I would like your help to find out why this matter is getting so much attention. Like I said before you can refuse if you wish with no worry of any trouble"<Tag dunowin>

The day the Federation, originally, turned its back on Seth and his people was a stormy day on Ascension; the only habitable planet in the Canis Major Delta system. Unpredicted changes in the weather caused havoc - mental and physical - across half a continent. The heads of thunderclouds lanced across the Waveka province, the administrative area that was located on a 'central massif' of the main continent. Waveka's exact position put it just inside the continent's south-west jurisdictional zone, thus meaning that the infrastructure was not sufficient to handle the crisis.
And they were alone; so the crisis was not handled, and as a result, over eleven thousand colonists lost their lives.
It so happened, seemingly by sheer coincidence, that another storm struck on the day of the young Helacaan's trial. Many saw it as a second physical affliction, a manifestation of the political blow the planet was being dealt by Seth's predicament. From Seth's point of view however, he, for once, did not care about the planet. All he saw was the beginning of another failure. No matter who he was fighting for back home, it didn't change the self-hatred he felt. Why could he not succeed in anything, whether it was for others, or himself?
The shock of authority's heavy hand crumpled him, weighing hard on his shoulders. Opening his eyes and reconnecting himself with his surroundings, he steadied himself against the table's edge. He shook his head. It was too much now. He was a man against the world, against reality.
"Lieutenant," the court aide returned, "This way please." The man indicated towards the far end of the reception hall, to a door set inconspicuously in the corner of the large place. Seth went without trouble, following the marginally taller fellow across the echoey hall, through the door into a smaller room.
It was the court, this time without the judge, independent adjudicators and all the others who somehow found their way into court-rooms. How he loathed them. The place looked shockingly empty, darkened too. He fancied he could hear whispers, the residual words of judgement echoing from earlier, coming from every surface, giving the place an intimidating aura. This was a place of balancing, of weighing-scales.
The aide put his PADD on the central desk, sliding it towards Seth who now stood opposite him. Seth picked it up, glancing with disguised contempt at the device's screen. "I'm sorry, Lieutenant Helacaan."
Seth looked at him. He opened his mouth, but then paused before finally asking, "What are the chances of making it through the next hearing?" He wasn't expecting a positive response.
The aide sighed, "If you want a probability I would say twenty percent, maybe less. It's not all over though, your defence still has many things to bring up."
"Not that you would, or should, know what those are," Seth said, irritatedly. He thought of Park, and how the first officer had assigned defence counsel for him, after Seth had told him that direct representation wasn't necessary. The Wezean should've suspected that Park would find a workaround. The first officer was now directing his defence of Seth from the ship, currently docked with the station.
"Well, good luck, Mr. Helacaan." The aide handed him another PADD and nodded, effectively dismissing Seth from his presence. He returned the nod with another disguised look of anger, then exited through the same door he entered. He walked to the panel on the wall opposite and accessed the communications grid. N-e-v-a-d-a, he typed.
"Lieutenant Helacaan to Commander Park, USS Nevada. Sir, the next stage of the case maybe somewhat difficult."

Back in the dark of the courtroom, a secondary door opened in an adjacent wall. Light spilled in in the form of a rectangle, dimmed briefly as a second man entered, and then shut off completely as the room was again sealed. That meant communications, as well as the doors...
The aide turned to the new arrival. "It's not looking good for Helacaan," he said, seeing whom it was.
"No, it's not. But that's just as well. Didn't you realise he's meant to fail?" said the new arrival.
"Yes, of course," the aide rebuffed the man's sarcasm. "But we need to be more careful; I keep saying it and people keep on not listening.
"Yes, yes, that's all in hand. Of greater concern is the time we reveal this to Helacaan. Haven't you seen how alienated he's becoming? Christ, of all people, he's the one we need to keep on our side. We both know his history."
The aide nodded, watching the other man standing there in the dark.

As he waited for the staff to all arrive he reviewed the most current logs on the hearing Mr. Seth had atteneded earlier. He was less the pleased by what he saw and could tell that something was very wrong with how things were going. They were moving to fast and seemed very one sided almost to the point that the decision was already made.
Quitely he opened a channel to the officer in charge of the hear a few minutes later a face appeared " How may I help you captain" pausing for a moment to collect himself
" You can start by telling me why normal procedures are being ignored Commander and more importantly what is the meaning of the first hearing with out me present."
the commander seemed shocked and was about to responde when he cut him off " By all regulations if I inform you I wish to be present at all hearings concerning my officer you are bound to do so no matter who objects to my being there. In short Commander you do this end around again I will have your but for breakfest" It seemed like the commander was about to respond with an answer " Commander all i want to hear is yes Captain I understand, you had no right to keep me away no matter if Lt Helacaan wanted me there or not. I'm responsable for this ship and its crew no office can object when it comes to that"
" Futher more commander if I see any more over looking regulations again or forgetting to let me know when the hearings are scheduled I will be calling a few friends in star fleet intelligence you could find your life becomeing quite unpleasent very quickly" before he could say anything else " That will be all Commander I suggest you don't cross me again for your own sake"
He was mad and needed to relax before his senior staff arrived. Something was going on hear and he could put his finger on it yet

Keran had heard the colonel order the senior staff to visit him before leaving for shore leave, but until now he'd been unable to leave the experiment he was running. As he cleaned up the equipment and packed away, he had to admit to himself that he wasn't looking forward to having some time off just yet. He'd only just arrived on board, he had no one to visit with on starbase and he didn't quite feel like part of the crew; even though he'd been asked to help with the investigation.
Once everything was neatly stowed Keran mad his way to the captain's ready room. As he did so he absently told the science officers to enjoy themselves, he knew that some of them, like him, would have their thoughts occupied with their work however he knew that just made them the more valuable.
The short trip in the turbolift didn't give him much time to think, but it was enough to cast his thoughts to his son. It wouldn't be long till Cooper's birthday and Keran longed to see what he was up to.
As the turbolift slowed Keran composed himself and exited as soon as the doors opened. He approached the ready room, pressed the door chime and entered when bade to. The colonel looked less composed than usual and Keran wondered if he had anything to worry about.
"Sir, I've sent the science crew on leave and was about to leave myself. However, if there is anything you need?"

Commander Park entered the ready room when permission was granted, He sat and listened to what was being said and thought about what was said.
"Sir i respect what Starfleet Command is thinking, However i don't belive you should lose your First officer durring this time. If we get called away you will be without two of your main command staff." Jon knew that command had point, being the advocate for a member of his crew could make his thoughts shift from where they need to be.
Jon understood what his Commanding officer ment with having to tell the other side of the case, but Jon only needed two things from the ship. One to get the records of the crewman and two the medical report.
"I will do my best sir..." Jon turned when the chime rang and turned to the door to see who entered. Jon stood and nodded to both officers when Runningwolf asked him to leave. "Sir just know i will stand relived but under protest, Should we be recalled to active duty i will be at your side on the bridge."
Jon walked out before the Colonel could say anything and the door slid shut behind him. Jon walked to the nearest console and tapped some commands into it recalling the service record of the crewman. He grapped a Padd and downloaded both records.
Jon went to the turbolift and headed to sickbay, He loctad the ACMO and got the medical report of the attack and he left there. He was just getting to Deck 2 and his office when his combadge went off.
"Lieutenant Helacaan to Commander Park, Sir the next stage of the case maybe somewhat difficult."
Jon tapped his combadge in responce. =/\= "I am sure it will be better then you think, I will be down shortly i have something to bring to the attion of the court."=/\=
Jon read the Padds and Opened a communications channel to his mothers. Hello mom i am back at earth i will be at Command for a few days but i get to you and dad soon. I love you and see you soon. Jon had to leave that becuse they were out, Leaving a auto recall feture in to communica he would be alerted to them when they got the message.
Since Jon was still aboard ship he got the communica from runningwolf and headed to the breifing room he had to inform them of this.
Jon entered the Breifing room he saw the Co sitting at the head of the desk, "Sir i know your duty bound to report this to the other side but i think you should see this anyway. On stardate 960260, Starfleet Command recived something from Lieutenant Helacaan's Homeworld yet there is no offical record of it. Also I have no record of it in the discovry given to the Advocate i assigned to his case." Jon saw no change in his face. "Sir do you know something i don't? I don't belive the Officer that Seth attacked well was said to attack wasn't but on this ship for a reason.

"That's good sir," Seth said after a pause. Suddenly he felt boosted; it pleased him to know that work was being done back on the ship to help him out of this crisis. If only he felt he could reciprocate their faith in him in equal measure. But his current mood wouldn't allow for it. "I'll await your information. Are you passing it on to the advocate, or have you been given leave yourself?"

Twenty minutes later and Seth was again engaged in long-range communication. He waited patiently while the communications link was patched through to the ship. He was sat, slightly hunched, almost as if curling into a ball, in front of a comms screen. With any luck, in a short while, Colonel Runningwolf's face would be appearing there. His Commanding Officer had apparently contacted the Court Officer, putting on a show of loyalty and expressing an interest in the defence of the case himself.
He found both his CO and XO's investment in this case touching; they didn't have to do it, yet here they were rushing to his defence. If he searched inwards, he found that he didn't know if he wanted it or not. Why drag others down with him? Well... He had six hours to the next sitting, so he had better make the best of it... A good start, he thought, seeing the Colonel's face appearing.
"Ah sir... Good to see a friendly face. How are things ship-side? I understand you spoke to the Court Officer."

Seth sighed, in the last moment debating whether he should say what he'd planned to. "Sir, I don't need any more help than what I'm getting. I don't know if the court proceedings are being followed correctly or not, but I cannot see what difference it might make. Surely them taking shortcuts is just speeding me along to the inevitable. Dishonourable discharge from Starfleet...
"I'm very grateful for all the support, do not mistake me sir, but I should be able to handle this by myself." Seth tried to look his commanding officer in the eye, failed. It had been an error; he had no right to speak like this to his CO from his current position... But might the Colonel agree with him anyway?

Looking around the room at his senior staff, he smiled they were fine officers. He knew he was lucky to have such a great staff in more ways then one.
"As you know we are about to start shore leave I wish it was under better circumstances then what they are. For those of you who are not aware LT Helacaan is under ivestitgation by star fleet. I state this not to embarce my officer but to stop the scuttle butt. As anything he is innocent until they can prove other wise."
" Our fine first officer Commander Park is representing him, I will be assuming some of Mr. Park duties until this is over. Mr. Park is not relieved as first officer but I will be having us pick up some of his work load. I know you all were looking forward to shore leave but I'm afraid with rank comes the down side of it. All department heads will over see the repairs and refits of there departments. This would normaly be done by Mr. Park but like I said we are going to take somethings off his plate. Crew issues will be dealt with by me with that being said what I'm about to ask is a favor. I have already asked some of you but now i"m asking all of you."
" You may of course refuse with out any fear of damage to your career or your status on this ship. While Mr. Helacaan has expressed his feelings that we stay out of this and let the system do its job I can not. I would not no matter who it was on trial if I saw things happening the way they are. While the details of this incedent are still unclear I'm concerned about the speed of it. Already I have notices several infractions of this hearing so I"m asking you to help me and Mr. Helacaan figure out who's pulling the strings hear. Why are the rules of law being over looked. I say this because the day we start taking short cuts in our legal system is the day nobody can expect a fair hearing. Again you may refuse if you wish but I ask you to think what if it was you and you found your self on a fast track to a predetermined out come" <Tag All>

Sharon had been working on her report and getting things in order down in security, setting the watches and shoreleave, she fdorgot about the meeting and hurried out of her office. She took the lift up to the bridge and headed for the Captain's ready room she walked in quietly and took a seat on the couch listening to what he had to say about the work load.
Sharon looked over at Jon and gave him a small smile, she had hoped they could spend some time together while the were on shoreleve but it looked like that was not going to happen. Sharon looked at the Captain ready to volunteer any help she could give that would be helpful.

Two hours after agreeing to help the colonel, Dunowin was still sitting in his office going over anything he could find about Crewman Abbey's background. According to his records, everytyhing seemed in order but Dun had a feeling all wasn't as it appeared. His main reasoning for his thoughts were because Abbey's record seemed too perfect. There were no gaps. No reprimands. Not even any verbal warnings. According to his records, Abbey has been in the fleet for over 6 years but had apparently been content to stay a mere crewman. He hadn't quite been able to out his finger on it but something was off and Dunowin wasn't gonna quit until he figured it out.

He smiled as he looked at each of his officers with out ordering them which he wouldn't do they all agreed to give up there personal time to help. It was a feeling of family one he was trying to bring to the ship. Standing up he walked around the table looking at each of them with a smile.
" Very good I can't say how proud of you I am on the same note please becareful. If you start to feel any resistance while you are working on this I want to know. If anybody ask you are to inform them to contact me. I will take the heat for the whole thing none of you will bare that responsabilitie."
" I don't know what we may find but I hope we will discover who's pulling the strings on Mr. Seth hearing and why. Everybody deserves due process and I'm going to make sure thats what happens no matter the out come. Nobody has the right to rush to judgement if they do they don't belong in star fleet''
" We all know what we have to do I suggest we meet back here in 6hrs before Mr. Seth has to report in again. Hopefully we will have something to hand Mr. Park he can use to slow things down again and get them on track again. We should work as a team each of us bringing our own skills and insight. Don't be afraid to ask the hard questions even if we might not like the trueth of what we hear. Again if you run into trouble contact me and I will take care of it"

It was five minutes 'til the court were next due to sit, and Seth's representative still had not arrived. He was sat on the bench outside the courtroom, waiting and hoping that someone, anyone, would come and tell him what was going on. Be it his defence counsel or at least a person with some explanation.
Bare light saturated his skin, draining away any thought that this was at all worth it. Why not just admit some form of guilt now? Even though he considered himself acquittable because of the - as he perceived - extenuating circumstances surrounding the case, the whole process was becoming more than tiresome. He might even have thought - he mused with gallows humour - that they were doing it on purpose, just to force him into making some statement of guilt.
Even worse, not only had the advocate failed to arrive, Commander Park hadn't showed up either. If the first officer wanted to bring something to the attention of the court, it looked like he'd have to arrive in the middle of the proceedings. Seth was saddened, he needed some support from a shipmate, he had to admit now. He would and had been saying otherwise.. but those were lies.
Now he knew that most of the senior staff were dedicating themselves to 'investigating the investigation', helping out not just with the actual proceedings and making a defence of Helacaan, but also looking into the procedures. Seth was vaguely aware of the shortcuts the judge advocate was taking; whether or not he was receiving instructions, and whether or not it was only because they often skipped stages in cases like this, it didn't make much difference. Either way, he was going to lose. Unless the crew could come up with something damning.

He got up and headed to the rest room. It was two minutes until the court proceedings began again. Washing his hands, he stopped, looked at the mirror. Standing straight, he tugged down on his uniform jacket, and smoothed out the creases in the golden shirt underneath. He stared into his own eyes and rubbed his smooth chin, usually adorned with bristly stubble.
Five minutes later...
Seth watched with a form of curiosity that he often felt at times like this. The judge advocate was walking in, looking altogether smart. He sat down, sighing and straightening his fairly straight hair. To Seth, this was a giveaway. Despite the judge's fine appearance, he was obviously tired, bored and would've slept quite late the night before. The judge advocate was a civilian; he wouldn't have to deal with the relative 'military-equivalent' waking times of Starfleet.
"Order," he said, pressing his chime. Seth stood up, alone at the moment, although he'd heard his advocate would be arriving in ten minutes. Park likewise was on his way, to sit in with the court. "Preliminary hearing number three in the court martial proceedings of Lieutenant Seth Helacaan, in the case of Lieutenant Seth Helacaan versus Crewman Charles Abbey and the Federation Starfleet. All present?"

Commander First Class Jon Park ran across the street into the Federation court building. He knew he was late for the court appearance but he had to check something. Jon went into the special orders division near the west side exit.
"Commander Park what can i do for you...Aren't you due in court?" Jon looked at the desk clerk "Yes Alice i am but i need the Orders for a Crewman Charles Abbey he was posted to the USS Nevada, However i can't locate the orders from Starfleet Personal." Alice walker had worked in the Special Orders division for 4 years and knew many of the Officers who came looking, Most time the orders where located here. "Well Commander there is no orders for that person that came out of here."
Jon was about to ask for that in writing when Alice handed her a Padd. "Thank you, I have to go." Jon ran out just as fast he ran in. Jon tapped his combadge "Park to Nevada, Tell Commander Wolf she was right. Park out."
Park went to the Closest Federation transporter and was transported to the Court house. He went to the court room and was stopped by a Court officer "I am sorry commander but court is in session and you can't go in." Jon looked at the officer "I am the council for the defendant so if you want to tell the Judge you denied a person his rights then fine." He opened the door "Sorry commander."
Jon went to the table and looked at Seth "Sorry i am late but i needed to get something important." He turned to the Judge "Your honor i would like to present some new evidence that will have the charges dismissed from my Officer."

Jon used the second Padd and copied the file handing it to the prosecution. Jon knew he had the smoking gun so to speck. Jon had found that the crewman was never to be on the Nevada and was AWOL from the USS Harold Hover.

Walking into the court room he noticed a bee hive of activity he saw Lt. Seth sitting but Mr. Park was no where to be seen. Walking up to his Lt " Seems you are missing somebody Mr. Seth"
As he waited for a response he heard the hearing call to order which was a little odd. As the Judge began the hearing he waited for a chance to chime in. " You honor as you can see Mr. Seth is with out council right now I know that he is on his way. I ask that we allow another 10 mins for Commander Park to arrive"
The response caught him off guard " Captain Wolf you were more the willing to preach protocal to Federation represenitive now you ask for some lee way I don't think so. Also you may be a captain but this is my court room and I have the power hear"
Holding his temper because he didn't want Seth to pay for it " Of course you honor I was just concerned how this might go in the press when a defendant doesn't have legal council present but you are the judge and no better then a simple colonel would by the way your honer its colonel not captain I would be grateful if you at least respected the rank I have earned"

"Your honor i would like to present some new evidence that will have the charges dismissed from my Officer."
There was a brief hubbub of noise - excited whisperings, shifting in seats in accompaniment with a few shocked faces - around the court room. Seth watched as the Judge frowned and looked about, lifting his small hammer to strike the chime on the desk in front of him. He struck it three times, with some pleasure, Seth noticed.
"Order. Order, now." The room died down again. Seth's eyes diverted briefly to the panel of five officers, those who, along with the judge, would arbitrate on his case. All five were impassive; unreadable.
"Now," the judge was saying, "This must be something quite significant, Commander Park, if you are certain it will acquit the defendant so comprehensively. At the risk of prolonging the court's sitting past its necessary time," the judge stifled a yawn, "Why don't we move your evidence to the start so we can - perhaps - do away with any further proceedings."

There was something a little wrong with what was happening here, Seth told himself. This didn't seem right. His eyes narrowed at the judge, trying to work out what was behind that man's indifferent gaze. Something about his demeanour spoke of confidence; dismissive confidence... As if, Park's evidence would be looked at, thought upon but only briefly, then thrown away as if it was and could only ever be nothing at all; something of absolutely no consequence whatsoever.
Seth wished for that confidence to be smashed. He didn't know what Park had for him that could be so liberating, but he hoped for the best, and saw this new, currently mystery-evidence as being capable of providing that.

On the Nevada, currently docked to its mooring at 'Base.....
The Assistant Chief of Operations, the Benzite, Lieutenant Hasak, strode the corridor to engineering. Entering the large two-levelled place, he sighed as whom he'd been looking for was in the end, not immediately visible. He was looking for Lieutenant Dunowin. "The chief?" he breathed at the engineer closest to him as he walked towards the warp core.
"Upper level, sir," the engineer spoke cheerfully, after turning to see that it was Hasak - the always friendly Ops officer.
"Lieutenant," Hasak said, approaching from behind and shifting a PADD into Dunowin's face. "You are young, Dunowin, so maybe you'll see what my eyes are unable to. Deprived of direct methane stimulation, us Benzites' eyes suffer somewhat..." He let Dunowin take the PADD.
"My superior, Lieutenant Helacaan, told me to take a look at the energy flow between the ship and the station, just before he left. Apparently there's a problem; he tells me the base isn't shifting all the power we need to us, as if they're looping some back to the 'Base before it reaches our main power grid. Keeping us down on power, perhaps, for when we switch back to our own... But why would they do that?"

Commander Park nodded and headed to the stand. After the oath he sat down. He held the Padd up. "I have discover what i believe is evidence that will dismiss the case on the grounds that if the person in question was never on the Nevada, Lt. Hellacann would have never been in the position to have the incident take place."
Jon tapped the Padd. "I have found that the person in Question has no orders from Starfleet command to be on the Uss Nevada and was transported aboard with fake orders."
The crowd was making noises and the judge ordered them to quiet down. "Commander Park where is this person assigned?" Jon looked at his notes and said "Yes your honor he is suppose to me on the USS Harold Hover. I contacted the CO there and the Hover is on a deep space mission and under communications Blackout."

The new evidence was certainly unexpected, Park had done well to find this one out. Usually when a crewman's name could not be found on the official roster it meant the orders had not filtered down through the lines of bureaucracy yet, but the first officer had had the insight to pursue his research, and it'd come good.
For certain, it'd taken Seth by surprise, and by the looks of it, the Judge as well. Seth watched the man as he appeared momentarily stunned to silence, gathering his thoughts. The Wezean tried to think what this might mean for the case; charges dropped as Park had hoped, or would they simply be reevaluated?
There was some shuffling from the opposite bench, telling Seth the prosecution had stood; they were objecting immediately it seemed, "I fail to see what this has to do with anything," the prosecutor said, hand sweeping in dramatic fashion as Seth shifted slightly to face the other bench. "The issue of Abbey's true place of assignment is not related to Helacaan's assault that nearly killed him."
"Noted," the judge said instantly, writing with a stylus on his PADD. "What say you, Commander Park? While your evidence is damning of Abbey, it doesn't change the issue with the defendant."
It was true, Seth admitted, staring at the bench in front of him as he ran what'd just happened through his mind, reasoning it out and finding its relevance and meaning. No, they needed something more if he were to get out of this. Park's information was a start, now they ought to try and show that Abbey wasn't acting alone in his 'reassignment', and was in fact part - perhaps - of some plot. Yes, unlikely, Seth knew, but if he did decide to try and help himself, it was where he'd start.
Distant claxons blared, instantly noticeable, then coming suddenly closer as each claxon-port in the corridor outside the court activated in sequence. Everyone in the court room looked 'round, murmurs increasing - as if they were all one organism being disturbed. On the judge's request, an aide made his way from the room, obviously to search out the cause for this disturbance. Seth looked across to Colonel Wolf, sitting down the bench from him; they shrugged at each other. A minute later the aide returned; heading straight towards the judge and whispering in his ear. The judge's expression turned dark.
"Ok, this hearing is adjourned for three hours," he boomed. "Be here exactly as you are now at 1600 hours; sharp."
The chime rang as everyone rose from their seats in noisy fashion. Seth yawned, looking around at the adjourned court room. Both Runningwolf and Park approached him. "Good work, sir," he said to the first officer. Park nodded, glancing to the large sliding double door as if to say to the other two, Let's get out of here.

"It seemed an open and shut case," the lawyer said, pacing to and fro at the front of the ante-room. His fingers brushed here and there on the edge of the table. "But you've turned it around, Commander Park. I can't thank you enough. Question is, though, where from here? None of this changes the fact that Seth here brutally assaulted this man."
It was two hours 'til the hearing resumed, and Seth, Runningwolf, the two Starfleet officer defence lawyers and the third in Jon Park were discussing what to do next. In truth, the three hour break couldn't have come at a better time, it was just the juncture they needed to gather their thoughts and make their next plan for attack.
For the moment, though, there was silence, as the group tried to think what they could try to discover next. Or invent, rather, Seth mused grimly. He sat with his elbows on the table, arms positioned so his hands partially covered his face.
"Colonel, Commander, if I may," the other lawyer addressed CO and XO of the Nevada. "We need to work from the premise that Abbey's presence on your ship was part of a larger plan to aggravate Helacaan. That's what your evidence was getting at Commander Park, I know, but we need hard proof. Were there any incidents of aggravation from Abbey, Seth?"
"A couple of times," he replied, "But only after the incident. The first one was my fault."
"Hmmm. Colonel Wolf, I'd like to suggest you have your crew investigating Abbey's exact movements since the incident with Seth. You also have sufficient right to request of Command that Abbey be arrested. Questioning him is the first and best route I can think of to discover why he was really on the Nevada."

"Why don't we just have a word with the prosecution?" Seth asked flippantly, lowering his hands to the desk with a thud.
The first lawyer, Lieutenant Commander Rossi, looked at Seth hard for a few seconds. "Because that would be a violation of our oath as members of the JAG office, Mr. Helacaan."
"Who cares? The Judge is already biased."
The critical expression on Rossi's features didn't fade, but he did swallow, "What are you suggesting?"
"The court's fixed; I'm going down in the wrong way for the right reasons. You're looking for a plot, there's already one taking place right now every time I step into the court. I've seen it all before," he swept his hand across the table, but managed to remain sitting. "Biased judges... influenced jury - those five members of the court in this case - and a bent Court Officer. The exact same kind of thing happens back on my homeworld all the time; the civil courts are infamously corrupt. Now the same type of people are working together, all busy rushing me out of Starfleet."
Rossi was about to reply when the other lawyer - the female Trill Commander Parram - cut in, "Well, we'll discuss this in a bit. Let's take a break for now, so you can prime your crew with the latest news, have Abbey arrested and so on. Say an hour?"

"What do you think?" Rossi asked Parram, once they were sure the Nevada officers - and specifically Lieutenant Helacaan - had passed out of sight. "Think he might be right about the court? Or was it just the mutterings of a man under stress?"
"Very factual," Parram replied, sitting in the one of the empty chairs in the empty ante-room. "Surprising for you not to exaggerate, Mirco... I think he might be right, to some extent. I'm not sure about his assessment of the judge though.. that one's always been like that..."
"Well, you're right, Helacaan doesn't know him. But perhaps that's a good thing; he doesn't have all the familiarity baggage attached; he sees what he sees... a dismissive judge with not much interest in proper procedure."
Parram nodded, looking thoughtful.

Commander Park was shocked, "Your Honor it make a big differance it falls under an old earth law called friut of the posions tree. Where if the person was where he should have been the crime wouldn't have been commited." Jon looked at Seth. "If Crewman Abby was on the Hover then he wouldn't have been in the postion to attack or be attacked."
Jon knew it was not a long shot but when the judge said it had no bearing he was about to object when alarmes went off. when the Judge put the trial in recess park went with the others to the advocates room.
Jon said as the advocates requested the crewman arrested "I am on it." Park moved to the side =/\= Park to Nevada, Commander Wlf locate and arrest Crewman Abby.Park out" JOn moved back to the others as he looked to his CO.
Jon thought a moment "Sir Seth has a good point why are we in a civil court and not a Starfleet one. This does smell a bit fishy..." Jon stopped a moment "Ah no offance." Park knew something was wrong he gor a call from the ship and moved off.
=/\= Park here. What understood find him." He moved back "Crewman abby is missing sir."

Dunowin took the PADD from the Benzite and began scrolling through the information. A moment later, he finally looked up and spoke.
"If this is right," he began, "than Lieutenant Helacaan is correct. Let's go." he said to the Lt. They headed back down to the lower level and Dunowin quickly took over a console that had all readouts of the power transfer. All levels showed as sufficient for what should be being fed to the Nevada. The CEO addressed a couple of his crew.
"Corbin. I want a manual readout of how much energy is being sent from the base into the Matter/Anti-Matter Assembly and the Dilithium matrix. Tarvi. You find out how much is being sent into the warp plasma conduits. I want your reports yesterday."
"Aye, sir." came the unison reply as the two men turned and headed off to their assigned tasks.
The ensigns returned within 10 minutes with the results that Dunowin had asked for. As he looked over the information, he was not happy about a couple of things. First was the fact that he himself had not noticed the difference in what the base said it was sending and what the ship was actually receiving. Next was the fact that someone had to be manipulating the consoles in Engineering to show the fake readouts. He was really starting to think about this conspiracy theory revolving around Lt Helacaan. Dunowin didn't want to admit that Starfleet would do such a thing but he had the evidence staring him the face. Coming out of his office, he called to one of his men once more.
"Corbin. You're in charge until I return. I have to go over to the base to sort some things out. Lt Hasak. You're with me."
The two headed for the transporter room.

"Nevada reports Abbey is gone," Mirco Rossi said.
"Gone? What do you mean, Mirco, be more specific will you?"
"Yes, ma'am," Rossi teased, poking Elihea Parram in the ribs as he walked past. She yelped a little and he took the seat beside her. "He's disappeared; didn't even check off the ship or on to the Starbase, but that's presumably where he went. No transporter signatures and no cloaked ships in the area, everything's already been tachyon swept once."
Parram sighed, pausing in her reading of the report in front of her. "That man is the most slippery individual I've come across. It's no wonder he made it on to the Nevada from the Harold Hover unnoticed."
"Quite," Rossi said. Parram heard a crunching noise, and looked across to see, to her disbelief, her fellow Commander tucking into a shiny apple.
He noticed her glance. "What?" he asked through a mouthful. Parram shook her head, effectively saying, 'never mind'. He took a few more bites, then took notice of the PADD in front of his colleague. "Catching up on some work?" he inquired.
"Sort of... Just reading up on the background of the judge and the service careers of the jury members. They all check out, but then we know the judge fairly well." She scanned down the page, finding the appropriate entry she had saved, then slid the PADD across to Rossi. "Also looked into Helacaan's history. Seems this isn't the first time he's been in trouble with the authorities during his service career."
Rossi looked at the entry, rose an eyebrow. "He pleaded guilty to assaulting an officer during fast-track training."
"Yep," Elihea said, "Beat the hell out of a Lieutenant security officer. Apparently the unfortunate man 'commented' on Helacaan's background."
Rossi looked at Parram slowly, blinking once before smiling jovially. "Ever wondered if we're defending the right person?"
"Corbin. You're in charge until I return. I have to go over to the base to sort some things out. Lt Hasak. You're with me."
Hasak twisted to and fro, observing the activity in engineering as Dunowin's crew hurried here and there, working consoles, trying to find out why there was less power being transferred to the Nevada than should've been, and if the 'Base were doing it on purpose. He nodded when Dunowin ordered him to accompany him to the station. Hasak decided he was happy to slip under the authority of the engineering department for a while, especially with his actual boss in the process of being court martialled...
He followed Dunowin out of engineering, trying to keep up with the quick strides and fast pace of the CEO. "What have you got in mind, sir?" he asked.

They descended the docking vestibule, which Hasak swore was longer than the standard version. He quickly shrugged; maybe it was because this was a different docking port to the one he was used to. Stepping on to the station, he had to change his step to be going in the same direction as Dunowin; it would be easy to lose the man amongst all these people. Where were they all coming from?
"So, where to, sir?" the Benzite inquired, once they'd passed out of the moving stream of people, "'Base Operations? Their version of the engineering department?"

Quietly, but with a particular set of grim determination, the half-dozen Starfleet officers made their way to the Nevada. The distraction provided by the flowing of personnel they'd had redirected to the docking ring - outside the Nevada - was a perfect way to sneak on unnoticed. It was on the ship that things would change. Their leader, Commander Naweski, had served with Starfleet Intelligence for nine years, before transferring on an 'official basis' to Starfleet Engineering Corps - but of course he was still under Intel's inescapable thrall. He'd just watched as a human and a Benzite stepped out of the vestibule from the Nevada, and now - with those two gold-collared officers gone - he steeled his jaw as he entered the Akira class ship.
Red claxons blared their alarms as the dark-set sextet entered a particular area of the ship. Of course, they had not accounted for the fact that the Nevada was already on high alert following the agent's 'disappearance'. Naweski cursed.
"INTRUDER ALERT. INTRUDER ALERT."
Crewman Bovois, at the Ops console on the Nevada's bridge, immediately took action on seeing what flashed up on his console. "Commander Wolf," he called in alarm to the CTSO (currently in charge of the bridge), "Intruder alert; deck 16! Six biosigns; five human, one Andorian."

Thirty seconds later, Bovois had more to report. "Commander, several sections report four of our crew have been incapacitated. The pattern of it makes it seem those intruders are on their way here, to the bridge."

Park was standing with Seth in the Hall when he got a Alert form the Ship. "Sir!!!!." Park said "The Nevada is being boarded by unknown people." Jon headed for the door and tapped his combadge. =/\= "Park to Nevada, Two to Beam up. Directly to the Armory hallway."
Jon turned to Runningwolf "Sir i believe we need Seth on this one, I will take responsibility for him." Jon turned to the lawyers "Inform the judge that the Nevada has been attacked and i have the defendant." Park tapped his combadge again =/\= Park to Nevada make that three to beam up, same location. Energize."
Next thing Jon saw was the Armory hallway. Tapping in his Command code the door slide open and they all entered. The door closed and Jon handed out weapons and hand Phasers. Jon tapped into the Internal sensors directly from the Tactical station on the bridge.
"Sir it looks like they are heading right for the Bridge, but there is 2 walking the deck in a search pattern. They must be looking for Abby." Jon said as he brought up the most direct root to the bridge. "From here we can meet up with them here and here." Jon pointed to the Secondary side of the corridor on deck 4. Only the starboard side has the most direct route to the bridge.

NOTE: This is a back-post, to be inserted between my last post (where the intruder alert goes off) and Park's subsequent reply. I meant to post it earlier but I didn't want to put too much up at once... Besides, you beat me to it in the end Jon! This can be almost be disregarded in the context of the Nevada's boarding, but it is essential background for the plot. Note this also means there was an extra sitting of the court in between the posts.
Seth stood in the corridor, counting down the last few minutes before he was due to reenter the court room, to resume his court martial for striking Crewman Charles 'Chuck' Abbey. The same Charles 'Chuck' Abbey that was now officially 'missing'.
Commander Parram stood across from him, silent, having already discussed everything pertinent to the next sitting; everything she envisaged would come up, or maybe rather, Seth thought, everything she hoped would come up. The defence advocate would likely have a larger role in this sitting, what with Runningwolf and Park's attention divided between locating the wayward Abbey and helping defend their judiciary-stricken COO.
The moment came and Seth followed Parram into the court room, already full with people who were just now taking their seats. He looked towards the defence bench long before he got there; the Colonel was present, next to his own designated seat, but Park was nowhere to be seen. Commander Rossi was also missing.
"Sir," he greeted, taking his seat next to Runningwolf, whom promptly shuffled up to allow Seth space. Few words were exchanged between them before the judge entered and took his grandiose chair, larger and more ornamented than the common modesty Starfleet liked to infuse into its furniture. Functionality over beauty always; for flaunting fancy design was a sign of arrogance and the division of class, both those things the Federation abhorred. Seth had already tried to convey his confusion - his inquisitive accusation - at this oddity, through facial expressions and bodily gestures alone. What was different today then? he'd been asking.
The civilian Judge Advocate surveyed the room with a look of arrogance, before striking his chime thrice. "Order..." he muttered, then coughed. "In the case of Lieutenant Seth Helacaan against the Federation Starfleet, this is sitting number seven; and this judge appeals to the members of the court that they let it be the last...
"President of the Board, you and the other members have heard sufficient evidence from both parties?" The Judge asked, turning his superior glance on the Starfleet Captain sitting with the other four members of the court. Being the most senior officer among those who were effectively the jury, this Captain would act as the spokesman of that quintet. Seth hoped he was wrong about the man, and that he wasn't in on this conspiracy, no matter how much of a nimrod he appeared to be. Now more so than ever, I must hope, he thought darkly, for if the judge was being serious then it was just about time for that kind of desperation to kick in...
The jury-Captain stood up. "Yes, sir," he said evenly, "We all agree that we've heard sufficient evidence."
This is grim, Seth thought. He knew they'd try to rush the court to a close once Park's evidence had come to light, but he hadn't envisaged it'd happen this quick. He fired beams of death at the judge.
"Then.. if there are no further objections," the judge leaned towards the members, then out towards the rest of the court room, and the prosecution and defence benches, before returning to the members, "Please retire for your final verdict on the defendant's guilt or lack there of."
Seth could see that Runningwolf desperately wanted to get up and say something, but he stayed the Colonel's hand, daring to place a hand on his Commanding Officer's shoulder in reassurance. He looked back to the members; two of them - the most junior ones - were obviously struggling to keep their objections back, their lips pursed and looking like they might want to relieve themselves... This is farcical, he thought in disbelief. Parram leant forward from behind Seth, whispering in his ear. He nodded and sat straight again, watching the proceedings as the judge spoke, the man intending to close the court down again. Seth leant back once more, signalling for Parram to come forward, and he whispered in her ear. The Trill Commander nodded and stood, making her way from the court room in somewhat of a hurry.
He looked 'round - knowing he likely wouldn't see this court room again except once for the sentencing - and, smiling despite the situation, he let out the smallest sigh. It'd been good while it had lasted.

Standing against the wall after the hearing, Seth was thinking of everything he'd been through since being assigned to the Nevada; through the numerous missions, the interpersonal relations, the stalwart Captains and everything right up to that very moment in the court-room, through none of it had he felt so lost and without direction. Except perhaps once.
Park, standing opposite him, received an alert from the ship. Seth didn't quite hear what it was about, as Jon had turned away to take the call privately. "Sir!!!!." the first officer shouted to the Colonel, turning back around quickly. "The Nevada is being boarded by unknown people."
Seth stood up straight, righting himself from his lean on the wall. He nearly asked a question but Runningwolf was already in front of his XO, expecting that any speech would now be directed his way in this emergency situation.
"Sir i believe we need Seth on this one, I will take responsibility for him." Park told the Colonel, before turning to Rossi and Parram, the latter having just arrived back from her dialogue with the JAG official for the sector. Upon Seth's allowance, she had contacted the judiciary HQ over the obvious deep-rooted corruption within the court, which had been made transparent by the procedural shortcuts and clear bias.
"Inform the judge that the Nevada has been attacked and i have the defendant."
Parram nodded, not seeing that there was much she could do to stop him. The court case was all but over, and now hopefully they'd be able to start digging around and uproot the corruption. As a consequence, she couldn't see too much of a problem in letting Seth return to his ship...
"I don't think so," Rossi objected, stepping forward. "We need Mr. Helacaan here so we can conclude this case. So listen here, mister," he began stepping closer to Park...
"Mirco," Parram sighed, "Come back here." She shook her head and looked to the Nevada's XO, "You're free to take the defendant, Commander Park. Good luck... for what it's worth."

Once more, Seth materialised on the Nevada, hoping it wouldn't be the last. They were just outside the armoury. He stayed mostly quiet for the first part, only vocalising a couple of times to acknowledge orders and reply to suggestions by the Colonel and Commander. Staying alert, the trio made their way into the armoury and equipped themselves.
Park pointed to a schematic of the section the intruders were soon to move through; Seth looked at it. Six of them apparently, moving efficiently and quickly, and having already taken out a number of the crew. It was time to intercept.
The three of them scampered down a length of corridor; they were all in full battle alertness - backing against the walls, peering around each corner and brandishing phasers ready to shoot. He and Park led the way, covering their CO. Park directed him to the other side; he nodded, taking up position on the right hand side of the intersection behind the wall ... Here they came.
The first one emerged from around the corner and seemed to realise early that something was wrong. He let off a shot with his weapon and ducked straight-away behind cover. Seth fired, planting one foot forward and taking down the second of the assailants, Park followed suit.
The firefight continued for another thirty seconds or so, Seth would've guessed, and by then he realised something was amiss. Not only were the enemy using Starfleet-issue phasers and wearing Starfleet uniforms, but there were now just two of them, as compared to the four there should've been.
He looked across to Park, who clearly recognised what was going on as well. "They're trying to flank!" He and Park moved across to the adjacent corridor, trying to get into a firing position while covering themselves from both lengths of corridor (which were perpendicular to each other). Too late, though, as a phaser shot lashed out towards them with neither of them, or indeed Runningwolf in appropriate cover.......
